The Property Litigation Lawyer will provide advice and management of property law disputes arising out of or in connection with the Trust’s operational and investment property.
Working collaboratively in a Legal team of 12 qualified lawyers, 4 Paralegals and one Legal PA, this is a national role providing legal advice on a wide range of property litigation matters affecting the Trust’s operational and investment property.
Location & coverage
The position will be offered on a remote working basis, with a requirement to attend our main hub spaces.
Key Accountabilities:
- Providing legal advice on property law disputes across the Trust’s operational estate (e.g. title, trespass, boundary disputes, rights and easements, restrictive covenants, rights of support and claims for nuisance).
- Conduct of property law disputes with adjoining landowners, occupiers and other third parties under supervision of the senior members of the team.
- Advice on the Trust’s rights and duties in respect of land under the Trust’s historic waterway enabling legislation and and the enforcement of the Trust’s other modern statutory powers.
- Liaising with external solicitors and Counsel to facilitate effective and efficient conduct of those property litigation matters being handled externally.
- Drafting letters before action, claims, witness statements, applications and other court documents, and compiling court bundles for issue at court and service on Defendants under supervision of the senior members of the team.
- Working with the Trust’s Claims Handler in relation to property law claims for third party loss.
Knowledge, Experience & Skills:
- Qualified lawyer (or equivalent) with a minimum of 5 years‘ property litigation law experience gained in private practice or in-house.
- Excellent oral and written communication skills
- Track record of providing proactive, expert and timely legal advice
- Ability to build collaborative relationships across all levels and disciplines within the Trust and with external legal advisers and to participate effectively in meetings.
- Comply with Canal & River Trust Health & Safety policy and defined standards, report incidents, accidents and near misses. Assess the risks and make adjustments to work methods where appropriate. Ensure all equipment (PPE, plant, materials etc.) is appropriate for the task. Consider your own and others behaviour.

Location and coverage
The role will be based working from home, with the allocation of a nearby Hub for collaborative working in Hatton (Warwick) or central Birmingham. This is a regional role and there will be an expectation that the successful candidate will be able travel to attend meetings or fieldwork throughout the West Midlands waterway network and occasionally further afield.

About the role
The post holder will be responsible for managing a diverse and high-volume workload of planning consultations and planning policy matters in their geographical area. With a focus on customer service, you will engage with a number of Local Planning Authorities, Parish Councils, interested parties and communities, along with a wide range of specialists and business areas within the Trust.
In the Trust’s capacity as a Statutory Consultee, you will comply with our “duty to respond” on consultations which vary in scale from EIA scale development to “minor” and “householder”. As part of your varied caseload, you will be responsible for negotiating the imposition of planning conditions and / or obligations to address issues, reduce potential liabilities and will be expected to represent the Trust in the appeal process. There may also be the opportunity to respond on behalf of the Trust to nationally significant infrastructure projects.
The planning policy element of the role will require you to develop relationships with local planning authorities to ensure that the opportunities of our network are recognised in the early stages of strategy formation and plan making, respond to consultations on Local Plans, Neighbourhood Plans and other planning policy related documents to support the work of the Trust. This may include representing the Trust, as necessary, at any relevant examination of the plan.
For this opportunity, we are seeking a qualified planning professional with significant experience of the development management process to work in a highly diverse and increasingly customer focused organisation. It would be preferable for you to have some experience of planning policy matters.

About you

Technical:
- A chartered Town Planner (or eligible) with a relevant Masters, Diploma or Degree level qualification.
- Knowledge and experience of the TCPA &/or DCO regimes including appeals and enforcement systems in England and Wales.
- Sound knowledge of planning, heritage and environmental law and regulations.
- Understanding of Government reforms & policy objectives, planning policy, procedures & regulations in England & Wales.
- Appeal experience ideally including public inquiries as expert witness and informal hearings.

About the role
This is an exciting opportunity, which offers a great variety of activities and tasks from day to day. You will be the public face of the Trust, working extremely closely with volunteers and with members of the public who visit and use our waterways. Your work will be a combination of day-to-day routine tasks and more exciting and involved project work. You will lead volunteers and the team to enable them to work safely and efficiently and help to foster a safe, secure and vibrant waterway network, where visitors are delighted with their experience. The role includes leading and attending events to publicise the work of the trust, promote our activities and recruit new volunteers. The post holder will also be required to work an annualised hours system which includes working any 5 days out of 7 including statutory holidays. They will also be part of a 24-hour operational standby team responsible for providing emergency cover for the waterway.
- Working outside, undertake on-the-job organisation, control and leadership of volunteer groups, volunteer task days, volunteer lock keepers and our in-house team.

The role of a Senior Building Surveyor provides technical expertise in the management of commercial and operational property to inspect, determine and prioritise actions as well as to identify and manage building works for delivery by framework contractors and to support all professional building surveying requirements within the Property Directorate. This will include advice in respect of maintenance planning, acquisitions, insurance, management of external consultants and management of commercial and operational tenancies.
The role is responsible for preparing budgets, to identify and manage projects, core, planned and reactive maintenance works and through the Trust’s frameworks to efficiently and safely deliver a programme of works and new strategies. The role will assist with ensuring that framework contracts deliver the agreed outcomes as determined by the Trust.

Skills, knowledge & experience:
Key accountabilities:
- Inspect, assess and prioritise building works to maintain the value and condition of the Trusts commercial and operational building stock.
- Ensure statutory compliance in respect of all directly managed commercial and operational property.
- Support all professional building surveying requirements of the surveyors within the Property Directorate teams.
- Provide advice in respect of maintenance planning, acquisitions, management of external consultants and management of commercial and operational tenancies, preparation and negotiation of schedules of dilapidation, assessment and monitoring of tenants' alterations, statutory compliance, measurement of buildings and preparation of insurance reinstatement cost assessments.
- Manage framework contractor to efficiently and safely deliver core works, planned and reactive maintenance works and projects.
- Prepare budget plans and forecasts in connection with contract expenditure
- Contribute technical advice during the feasibility, design, construction and commissioning phases for projects. This will include, TRUST Direct Services,
- Framework Contractors and Volunteers.
- Where required, act as Lead Designer / Designer for relevant works, being responsible for providing expert building analysis and advice in relation to determining solutions to the prioritised list of infrastructure risks and improvements. Including CDM appointments for both client and Design roles.
About you
- Chartered Building Surveyor or Chartered Builder (RICS or MCIOB) to provide necessary confidence for both Trust and external parties that advice provided is appropriate and competent.
- Demonstrate extensive experience of construction of buildings and building defect diagnosis across a variety of building types.
- Experience of administering a range of construction contracts and in particular NEC contracts for maintenance works and project delivery.
- Experience in a range of professional surveying services including but not limited to preparation of schedules of dilapidation and negotiation of same, measurement of buildings, preparation of insurance reinstatement cost assessment, preparation of maintenance plans
- Knowledge of historic building defects and methods of repair.
- Ability to apply professional thinking in relation to forming conclusions from legal/ statutory standards and records to support their resolution to problems, having a substantial knowledge of statutory legislation relating to buildings.

Hydrographic Surveyor

We currently have an opportunity for a Hydrographic Surveyor to join our fantastic Asset Improvement team. This individual will play a key role covering all of England and Wales.
This Hydrographic Surveyor will be part of a small team responsible for collecting, processing, analysing, interpreting, and presenting spatial information on the waterway environment.
Location & coverage
Administratively based from our Leeds or Newark hubs, this vacancy will be offered on a hybrid basis, with a requirement to attend our hub spaces as and when required for team working.
This role will require regular travel across the Trust’s national network of reservoirs, canals and river navigations to carry out site surveys. Site work is usually carried out Tuesday-Thursday. All site visits start Tinsley Marina, Sheffield - where the team’s equipment, van and boats are stored.
The regularity and distribution of travel will be discussed further at interview stage.
Travel: This role will require regular travel (2 - 3 days a week) across the Trust’s national network of reservoirs, canals and river navigations. Around 30 - 35 overnights away from home per year may be required.
About the role
The Hydrographic Surveyor will assist the Senior Hydrographic Surveyor in planning and carrying out multibeam and single beam echosounder surveys of canals, rivers, reservoirs, and docks. They will be responsible for post-processing the acquired data to generate outputs for use in the wider organisation including dredging, reservoir safety and engineering.
The role holder will work cross functionally with others, contributing to the development and implementation of waterway asset management strategies and plans, and providing technical advice to support the Trust’s operation, maintenance, repair, and renewal of waterway assets.
Your key accountabilities will include:
- Mobilisation and calibration of survey equipment.
- Responsibility for undertaking hydrographic surveys, ensuring that they are completed to plan, data is reviewed, approved and recorded in the prescribed format, to the prescribed quality.
- Supporting others to assess the outputs from hydrographic surveys, making informed recommendations and proposals on the prioritisation of required work.
- Ensuring that the team’s survey equipment and boats are maintained and serviced.

About you
Whether you're building on a few years of industry experience or a more experienced professional looking for a new challenge with greater flexibility, we’re seeking a capable and motivated team player with a passion for working outdoors and travelling.
You will be required to drive the team’s 4x4 vehicle as well as towing boat trailers to site. During surveys there will be an expectation to operate the team’s echosounder and other survey equipment, as well as handling our fleet of small survey vessels. Full training will be provided.
Technical:
- Degree or equivalent, in relevant discipline.

About the role
This is an exciting opportunity, which offers a great variety of activities and tasks from day to day. You will be the public face of the Trust, working extremely closely with volunteers and with members of the public who visit and use our waterways. Your work will be a combination of day-to-day routine tasks and more exciting and involved project work. You will lead volunteers and the team to enable them to work safely and efficiently and help to foster a safe, secure and vibrant waterway network, where visitors are delighted with their experience. The role includes leading and attending events to publicise the work of the trust, promote our activities and recruit new volunteers. The post holder will also be required to work an annualised hours system which includes working any 5 days out of 7 including statutory holidays. They will also be part of a 24-hour operational standby team responsible for providing emergency cover for the waterway.
- Working outside, undertake on-the-job organisation, control and leadership of volunteer groups, volunteer task days, volunteer lock keepers and our in-house team.
- Leading and attending events to publicise the work of the trust, promote our activities and recruit new volunteers.

- Develop volunteering opportunities on River locks.

About you

We are a team of engineers and technicians that design and/or manage the design of repairs on a diverse range of our historical assets to keep our canals open and alive. We provide the designs of technical solutions, preparing specifications and briefing documents for our direct labour force, external contractors, and consultants.
We are currently looking for a Senior Civil Engineer to join us on a 1 year fixed term basis to provide this support in the southern areas of England and Wales.
Our role is to provide designs to maintain, repair and rebuild the Charity's infrastructure, conserving and enhancing it to enable visitors to safely enjoy our canals and rivers, and safeguard them for future generations. Our aim is to develop efficient and innovative engineering solutions to the multitude of challenges we face maintaining our precious waterways and infrastructure day to day.
Our Operations Directorate includes reactive maintenance teams who need engineering advice to deal with the repairs needed to keep the canals operational day to day.
Specifically, this role will:
- Provide the needed engineering support, for our operations and Reactive teams.
- Investigate, develop and specify cost effective engineering and construction solutions ensuring best value, considering user requirements and whole life costs.
- Design and specify engineering solutions and where required, act as Principal Designer and/or Designer for works in accordance with CDM 2015.
- Provide designs for the maintenance, repair and renewal works delivered by our teams and external Contractors, taking account of, all statutory, technical, operational and customer requirements.
- Be technical advisors to the Charity’s internal construction functions, agreeing standards and specifications.
- Where required, provide temporary works designs for works delivered by the Charity’s internal construction teams.

About the role
Our Engineers are important to the success of the Canal & River Trust. The role will involve designing and contributing to the planning of repairs on a diverse range of historical assets associated with the canal network. As one of our civil engineers you will complete designs of technical solutions, preparing specifications and briefing documents for our in-house construction teams.
These are extremely varied, interesting and challenging roles. Whether you are coordinating with stakeholders, delivering innovative solutions, helping to define standards and procedures, or working with our teams on the ground; you will be working to conserve and enhance our navigable waterways for future generations; keeping our canals open and alive.
Key accountabilities:
- Development of simple designs to address defects using existing standard solutions, and bespoke solutions to more complex defects and engineering issues.
- Investigate and develop cost effective design and construction solutions ensuring best value, considering user requirements and whole life costs.

- Incorporated/Chartered Engineer or equivalent professional qualification.
